This report details the day to day activities of the ASCA
Board of Directors and includes issues before the ASCA Board and
communications done by mail, fax, email and/or phone.

93:19 Board Policies--Discipline
Motion by Berryessa, second by Trumbull-Clark
I move that the following be placed in the policy manual under Discipline:
Any communications that request inclusion of a complaint letter in a
Judge's or member's file shall also be sent to the person the complaint is
about advising them that they may prepare a rebuttal statement that will
also be placed in the file.
The person requesting the inclusion of the complaint letter will be sent a
letter advising them of this policy before the complaint letter is sent on
to the Judge or member. If they withdraw their request, the letter will
not be included in the Judge's or member's file or be sent onto the Judge
or member.
Comment: We do not have a standard procedure to deal with complaint
letters whose author does not want to file an Official Complaint Form.
Anyone who is having a complaint letter placed in their file should have
the opportunity to know of the letter and the chance to give a rebuttal
statement.

#6.12.4b, to read "ASCA will allow a reimbursement per the Standard
Mileage Rate as published by the IRS for travel to and from the airport
departure." The rest of 6.12.4 to remain the same.
#6.12.5a, to read "Ground travel expense to meetings will be reimbursed
per the Standard Mileage Rate published by the IRS or the equivalent of
the most economical airfare..."
36.12.5b, to read "While in the area of the meeting site, ASCA will allow
a reimbursement per the Standard Mileage Rate as published by the IRS when
the vehicle is used..."

Comments: The current policies named above each use a numerical amount for
payment of mileage, $.25 a mile. This amount is currently well below the
Standard Mileage Rate as published by the IRS which is (today) 32.5
cents/mile. By changing the wording to reflect what is and will be
published by the IRS, we shall keep the policy current and correct. It
has been usual to pay the cost of airfare for the last couple of years, as
it has been lower than mileage, so these changes do not make a radical
change, but do bring us current and correct with allowable mileage
payments.

97:14 DNA Committee--(ASCA-DNA) Hardship motion-Revised

Moved that the DNA Committee's Hardship rules #97.14 which is deemed
approved on July 10, 2001 be deleted and replaced with the following:
under ELIGIBILITY #9-
Add in after..."All applicant dogs must be DNA profiled by an approved
ASCA laboratory"
9a) IF the applicant dog's Sire and Dam are alive and available, the
applicant dog MUST be profiled DNA-VP. The costs of which are to be borne
by the applicant.
9b) IF the applicant dog's Sire and/or Dam are deceased or unavailable,
the applicant dog will then be profiled DNA-CP. A dog's Sire and/or Dam
are considered unavailable, if the owner refuses to allow DNA, the owner
cannot be found or the owner refuses to cooperate with the collection of
the samples needed.
9c) IF the applicant dog is to be registered as "NOT FOR BREEDING" the
protocol in 9a or 9b must still be followed.
9d) IF the applicant dog is DNA-CP profiled (under sec. 9b) the applicant
must sign a release form acknowledging all ASCA rights and registry
privileges will be revoked should evidence of either (i) the hardship
applicant's Sire or Dam were, in fact, available or (ii) that any
information supplied by the applicant was incomplete or inaccurate.
9e) All applicants for dogs (either DNA-CP or DNA-VP) will provide a
CERTIFIED pedigree(s) covering AT LEAST 3 generations including all
registration numbers, from all the registry(s) in which the applicant dog
and its parents and grandparents are currently or were registered. All
certified pedigree(s) must state that the dog/bitch, its parents and
grandparents or registered breed is an Australian Shepherd.

4) For applicant dogs to be DNA-VP Hardship registered (under sec. 9a)
Submit (3) color photos, (full body, left side; full body right side; and
full front view) for the applicant dog, as well as its Sire and Dam.

Comments: The previous rules were incomplete and did not cover inaccurate
or incomplete information. Since amending motions is not allowed this is
the only mechanism left.

Letter of Dissent: Peter C. Adolphson: 7/31/01
This letter of dissent is being submitted for the record in order to
publicly document my disapproval of this motion because of the methods and
processes employed by members of the ASCA Board for communicating and
interacting with committees and committee members, addressing general
issues, and voting on rules, policies and procedures. As a matter of
principle, I hereby issue my opinion that the process and procedures used
to put forth the motion "97:14 DNA COMMITTEE - [ASCA-DNA] Hardship motion
- Revised" did not follow historical Board procedures, particularly when
interacting with an ASCA committee. Specifically, neither the DNA and
Genetics Committee members nor their liaison were consulted concerning the
alterations made to their original motion. No attempt was made by the
makers to request that the committee conduct a formal committee vote or
consensus opinion regarding the changes to the original committee motion,
nor was any attempt made to obtain informal committee opinions by the
makers, nor was a courtesy explanation of the changes given to the
committee by the makers.
Historically, the authority to put forth recommendations to the Board
concerning DNA requirements was approved by the Board through the
following mission statement of the DNA and Genetics committee approved in
July 1997:
Mission Statement:
The DNA Committee of the Australian Shepherd Club of America has been
established by the ASCA Board of Directors with the explicit mission of
developing policies and procedures for the implementation of a DNA program
which fairly and with universal equity supports the ethical and practical
breeding of the Australian Shepherd by its members in order to promote and
preserve the genetic integrity of the Australian Shepherd breed as defined
by its members and set forth in the ASCA Standard.
This mission may be accomplished by, but is not limited to:
? Using the best, most practical, and scientifically acceptable
methodologies available for parentage verification and research of
genetically-based diseases;
? Educating the membership by any and all means practical;
? Surveying the members to ascertain their level of satisfaction with
regards to the management and direction of the program;
? Promoting and encouraging the use of the program by offering incentives
to its members for active support and/or participation; and
? Recommending program changes to the Board of Directors thus ensuring
that the program verifies and maintains the genetic integrity of the breed
registry of the Australian Shepherd Club of America.
And, although it may be argued that the intent of the original motion was
not altered significantly, if the process which was employed were to
remain unchallenged and undocumented at this juncture, an unchallenged
precedent would have been recorded in the historical records of ASCA.
This letter of dissent formally puts the Board on notice that I fervently
disapprove of the type of actions demonstrated here, as they represent
disregard for membership input, whether intentional or unintentional in
nature. These actions also ignore the status of ASCA as a membership Club
and imply a non-democratic government. Furthermore, I request that the
interpretation of parliamentary and Board procedure and its relation to
the ASCA bylaws be addressed with swiftness and focus to prevent further
deterioration of the governmental process. The above-mentioned issues
should be addressed via a formal review by a third party parliamentarian
to prevent further misapplication of presumed Board authority.

13.1 Budget: Host Club shall submit a proposed budget to the Board and
Obedience Committee at least six (6) months prior to the Finals.
13.2 Funds: Entry fees collected by the Office will be used to cover any
expenses the Host Club(s) may incur including awards. The Business Office
will keep an accounting of all monies received for the Finals fund and is
responsible for informing the Host Club(s), the Board of Directors and the
ASCA Obedience Committee as to the amount received by August 1st of the
competition year. The Host Club(s) will submit their expenses to the ASCA
Board of Directors. When all expenses have been met any additional monies
will be used for funding the next year's competition.
13.3 Positions necessary: 2 judges, 6 stewards
13.4 Equipment necessary: 2 complete ring set-ups, 2 full sets of
regulation jumps, arm bands, chairs and tables for each ring, calculators
(2), stopwatches (2), clipboards (2), stapler and staples, scotch tape,
white-out, push pins, broad-tip markers, pads of lined paper (2), pens,
scoreboard to post scores, shade or covered areas for Judges, Run Order
for each Judge, cards for exercises for Super Dog. If mats are required,
the entire ring(s) should be matted.
13.5 Trophies and Ribbons: Costs for trophies and ribbons shall come from
entry fees and/or donated monies. The Host Club(s) is responsible for
procuring trophies and ribbons. All placements will be awarded including
non-qualifying scores.
a.) Trophies: A special award or trophy will be given to the winner of
each class (Novice, Open, Utility and Super Dog).
b.) Ribbons: Rosettes will be awarded for each class placement from 1st to
10th place. All exhibitors not placing in the top ten in each class will
receive participation rosette labeled "Finalist". All ribbons will have
the date and location of the Obedience Finals printed on them. (Please
see [new numbered] Section 21 for complete list of ribbons required.)
13.6 The National Catalog will contain a list of all Finals Qualifiers by
class. The following information must be provided for each dog: sire,
dam, owner, date of birth, sex, breeder, handler.
13.7 The Host Club will provide the Aussie Times Editor with the Results
of the Finals, to be published with the Show/Trial report for the
Nationals. Each dog will be listed, with the owner identified and all
scores earned.

Effective 1-1-2002 the following changes will be made to the ASCA Registry
General Rules and Regulations:
Kennel Name Regulations:
1. Change to read: Kennel names registered from 1971 to 1/15/76 are a
lifetime issue and may not be reassigned except by transfer. There are no
further kennel renewal fees, unless the kennel name is transferred.
2. Add: The original owner of the kennel name may renew or transfer the
abandoned kennel name for the first 5 years following abandonment of the
kennel name, but after the 5 years has passed, anyone can register the
kennel name as their own.
3. Split off the 2 last sentences "Applicant(s) must have been an ASCA
member(s) in good standing for two (2) previous consecutive years.
Applicant(s) must be 18 years of age or older" and make them section 1 and
renumber accordingly.
Change the second sentence to read: "Once the kennel name is accepted and
registered with ASCA, no other breeder or owner will be permitted to use
the Kennel Name or sound alike names without written permission of the
recorded owner(s) of said Kennel Name", when the Kennel Name is placed at
the beginning of a dog's name or at the end when it is preceded by the
word "of".

5. Add: It is suggested that the kennel name not contain the words
Aussies, Kennels, Farms, etc as the entire kennel name is required to be
used when naming the dog.

Change sentence 2 under Required Fees: Delete the last sentence and add:
Member rates will apply when a full member pays the registration on a dog
co-owned with a non-member or service member or when the breeder, who is
a full ASCA member, pays the litter or registration fees for puppies they
have bred or co-bred.
This motion clarifies some unclear areas in the Kennel name regulations
and also limits the exclusion of words contained in a kennel name to
certain locations.

litter owner, after review by the ASCA BOD.
Comments: This simply clarifies to whom the revocation of ASCA privileges
applies.

I move to accept the following as a new program for Litter Owners in order
to Individually Register every puppy in a litter at a discount. These
rules to be placed in the Registry Rules as follows, effective January 1,
2002:
WHOLE LITTER INDIVIDUAL REGISTRATION
The Litter Owner may send to the Business Office, in a single package, all
the Individual Registration Applications, properly completed, with the
appropriate fee listed below.
1. Every puppy in the litter (other than those listed as died or culled
on the Litter Application or those mentioned in #2 below) must be
individually registered with either full privileges or as Not for Breeding
by the Litter Owner. All completed Individual Registration Applications
for the litter must be received by the Business Office at one time.
2. If a puppy has died after the Individual Registration Application has
been sent to the Litter Owner, the owner shall write boldly across the
original Application "deceased" or similar wording to indicate the puppy
died. This original Application shall be included with the complete
package of the litter's Individual Registration Applications but shall not
be counted in the number of pups in litter when calculating fees.
3. Fees
Litter age: 1-12 months - $7.00 per puppy
Litter age: 12-24 months - $15.00 per puppy
Litter age: 24 months and over - $30.00 per puppy
Comments: It is true that only a small portion of pups per litter ever
get Individually Registered. This new program allows the Litter Owner to
individually register their pups in a group at a discounted rate.
Allowing for more registered dogs for the Breeder and ASCA.
If a Litter Owner desires to have all pups in a litter Individually
Registered, the above allows for a discounted price from the Individual
Registration fees. A single Individual Registration fees today are: 1-12
months $10, 12-24 months $20, over 24 months $40. We have discounted the
cost for each individual and made it less if more pups are registered
sooner.

The Agility Committee recommends to the Board that the following changes
be made in Section 2.3-Jump Height Tables and that if this recommendation
is approved by the Board it be published in the AUSSIE TIMES and in the
June 2002 edition of the Agility Rulebook:
In the current table "Dog's Height at Withers for Dual Sanctioned
ASCA/NADAC Trials, change 4 column headers:
- the column header that now reads "13" and Under" (thirteen inches and
under) be changed to "14" and Under" (fourteen inches and under)
- the column header that now reads "17" and Under" (seventeen inches and
under) be changed to "18" and Under" (eighteen inches and under)
- the column header that now reads "20" and Under" (twenty inches and
under) be changed to "21" and Under" (twenty-one inches and under)
- the column header that now reads "Over 20"" (over twenty inches) be
changed to "Over 21"" (over 21 inches)
In the current table 'Dog's Height at Withers for ASCA-only Sanctioned
Trials, change 2 column headers:

Discussion: NADAC had decided to raise shoulder cutoffs for the 12", 16",
and 20" jump heights. The NADAC 20" jump height shoulder cutoff will now
be brought into alignment with the ASCA shoulder cutoff.

registered. There MUST BE NO "unknowns" in the first 3 generations of the
pedigree(s).

Rationale:
Although the requisition of the certified pedigree does not fall under the
realm of the DNA Committee, the ASCA DNA and Genetics Committee
respectfully requests that the BOD include this request as part of the
motion. It is felt that the inclusion of a certified pedigree when
paired with DNA profiling will aid significantly in the protection of the
integrity of our registry. It is also hoped that the Hardship Request
form will include the addition of a space for a tattoo, microchip, CERF or
OFA number, for the applicant dog, and its Sire and Dam. This should also
include the DNA-CP profiled "NOT FOR BREEDING" dog, as this dog has the
potential to become a vital addition to the DNA data base. These are all
permanent forms of identification and when paired with DNA profiling will
provide added security for the registry.

98:11 Obedience Rules--(2 dog minimum)
The Obedience Committee recommends to the Board of Directors the following
motion, effective as soon as possible:
To remove the two (2) dog minimum criteria from the Open Stay exercises to
allow just one dog to compete and qualify, the following changes to the
Obedience Rules will apply:
Chapter 1, Section 2
Delete the second sentence of the second paragraph: "In the Open Classes,
in order to earn a qualifying score, there must be a minimum of two (2)
dogs competing in the Open Group Exercises."
Chapter 4, Section 4
Put a period after: Sanctioned Obedience Trials
Delete: "provided the minimum of two (2) dogs participate in the Open
Group Exercises."
Add a sentence in Chapter 4, Section 14 at the conclusion of the first
paragraph as follows: "A Group, in the case of the Open Class only, shall
consist of one or more dogs and their handler/s."

Comments: The Committee felt that a single dog should not be penalized if
no other Open dog was entered and since the only difference between the
Novice and Open stays was time and distance, the dog had already passed
the "other dogs in the ring" part in Novice. Also, even under the
existing regulations it is possible for a dog to earn a leg by doing a
long sit (down) by itself in the ring. Suppose that during a group sit
(down) a dog breaks its sit (down) because of some unexpected event. The
judge has the option to rejudging the dog that broke. According to
Chapter 2, Section 8, "should there be no further group within that class
the dog or dogs involved shall immediately do the exercises alone."
98:11 Obedience Rules--LEP
The Obedience Committee recommends to the Board, the following motion,
effective as soon as possible.
Add to the Obedience Rules, after the first sentence of Chapter 1, Section
1.10 the following sentence:
For the purposes of all ASCA awards, rankings and trials, LEP Australian
Shepherds are considered ASCA Registered Australian Shepherds.
This section would then read as follows:
1.10 Obedience classes need not be limited to Australian Shepherds only,
with the exception of a SPECIALTY, then it shall be for ASCA registered
Australian Shepherds ONLY. For the purposes of all ASCA awards, rankings
and trials, LEP Australian Shepherds are considered ASCA Registered
Australian Shepherds. Other breeds entered in obedience trials sanctioned
by ASCA Affiliate Clubs must abide by ASCA Rules and Regulations.

The Committee wanted this in the rules so that there would be no confusion
as to our intent.
