00:04 2001 Elections--Elections Calendar

Motion by Toft, second by Trumbull-Clark

I move the elections calendar be published in the May-June Aussie Times as
follows:

May---Foreign ballots will be mailed May 1, or the first business day
thereafter.  Ballots sent to the US membership May 15, or the first
business day thereafter.  If a ballot has not been received by June 1,
member(s) should contact the ASCA Business Office.
July 15---All completed ballots are due in the hands of the receiver (not
postmarked) on or before July 15.
July 20---On or before this date, all director Candidates to be notified
of election results.  Official notice of voting results will be given to
the membership at the General Membership Meeting at the ASCA National
Specialty.

Comments:  We suspended mention of these dates previously.  It is now
confirmed there will be no proxy issues this year.  This schedule is the
usual elections schedule (see Board Policy 10.1) and can be implemented
since the proxy deadlines will not be an issue this year.

99:13  2001 National Specialty--Educational Seminars

Motion by Trumbull-Clark, second by Toft

I move that ASCA pursue the General Purposes as stated in our Articles of
Incorporation which read, "To promote, encourage and facilitate the
breeding and improvement of the Australian Shepherd Dog" and "To obtain
and exchange information regarding the scientific breeding and raising of
the Australian Shepherd Dog" by sponsoring a series of seminars relating
to genetics to be given by CA Sharp during the week of the 2001 National
Specialty.  These seminars to be free of charge to all who attend.

Ms. Sharp has volunteered to give two one hour seminars per day, with
question and answer time following, starting on Sept. 16, 2001 through
Sept. 21, 2001, for a total of 12 seminars.  The topics shall vary with
some topics being made available twice during the week in order to try to
accomodate the schedules of our members attending the Nationals.  Ms.
Sharp shall choose the subject matter of the topics from her knowledge of
what our members need or most commonly request.

The current airfare price for Ms. Sharp's travel is approximately $465.00.
ASCA's travel agent will continue to monitor the cost for airfare and if
it goes down in a reasonable period of time prior to Nationals, will
notify the ASCA President so the ticket may be purchased at a lesser cost.
Motel cost for Ms. Sharp's stay is $70/night for seven nights, totalling
$490.00. Ms. Sharp has volunteered to rent her own car, so arranging
airport pickup and transportation to and from the show site will not be
necessary for ASCA to make.  Ms. Sharp has agreed to no per diem costs nor
speaker's fees.  The approximate total for the twelve seminars will be
$955.00.

Ms. Sharp has volunteered to help in any DNA Blood Draw booth that may be
organized by the Host Club or ASCA during the week of Nationals.  She has
also volunteered to be available at the ASCA booth during any time which
may be scheduled to be manned by the ASCA DNA Committee.

CASA has approved the series of seminars and is helping to locate adequate
space at the show site.

99:13 2001 National Specialty--Photo Contest

I move that ASCA sponsor and hold a Photo Contest to be held at the 2001
Nationals.  The criteria shall be:

1.  This contest is open to all ASCA members.
2.  That there be three categories for entry: Working Stockdog, Aussie(s)
in the Outdoors and Puppy/Puppies
3.  That the award for first place in each category be a full page, black
and white with one photo advertising space in the AUSSIE TIMES.
4.  Photo must include at least one Aussie
5.  Color or black and white photos accepted
6.  Minimum 8" x 10" photo must be matted
7.  Multiple entries accepted
8.  Entry form must be sent with each photo
9.  Name, address and category must be marked on the back of the entered
photo
10. Entries must be received by Sept. 1, 2001.  Entries to be sent to Kyle
Trumbull-Clark

The judge to be named and the judging date/time to be announced in the
July/August AUSSIE TIMES

The enclosed faxed ad to be placed in the May/June issue of the AUSSIE
TIMES to promote the event.

Comment:

There are two good reasons for ASCA to hold this Photo Contest:
1.  This is a fun, easy way for ASCA to provide another good experience
for all of our members to share together at Nationals.  Having some
interesting photos of our dogs displayed at Nationals promotes our breed
and is a positive experience for our members;
2.  Photos (provided per the release) are much needed by ASCA for
advertising and promotion.  The release has been approved by the attorney.

CASA has approved this project to be held during Nationals and is helping
to organize the display needs of the photos.  A judge is currently being
sought from the local area.  Kyle Trumbull-Clark has volunteered to accept
the entries, bring them to Nationals, put together the display, organize
the judging, return any unusable photos and arrange notification to the
winners.

90:38 Agility Committee---Code of Ethics

I move that this COE be placed in the Agility Rule Book, after the index:

CODE OF ETHICS FOR ASCA AGILITY JUDGES

Judging is a privilege, not a right.  The ASCA Agility Judge's conduct
must always be impartial, dignified, and becoming to the judge, to the
sport of agility, and to ASCA.  A judge's actions must be above reproach.

Judges shall be professional in demeanor and arrive neatly and
professionally dressed, with due consideration of anticipated weather and
ring conditions.

Judges shall refrain from negative comments about individuals, dogs and
other judges, except when required in the course of trial administration
and disciplinary procedures.

Agility placements shall be awarded strictly on the dog's and handler's
performance as a team as described in the ASCA Agility Rules, and in no
case shall be based on the identity or reputation of the owner, the
handler, the breeder, or the dog's lineage.

The safety of the dog and handler shall be the judge's foremost concern in
designing, setting and judging courses.

Judges shall be ever mindful that trials are staffed largely or entirely
with unpaid volunteers, and shall treat trial workers, exhibitors and
spectators with due courtesy and consideration.

Any judge found to be abusing the privilege of judging for ASCA or
violating this Code of Ethics may have such judging privileges revoked or
suspended by ASCA.

Comment:  The Agility Committee wrote this COE keeping in mind that there
were specific issues that are unique to agility.  One being that ASCA
agility is open to all breeds including mixed breeds so they didn't feel
that there needed to be any reference to the ASCA breed standard.  They
also wanted to be more specific about fraternizing.

"Another company is offering insurance coverage to dog clubs in addition
to Sportsmen's.  That company is RV Nuccio and Associates and the coverage
comes through Fireman's Fund.  An informational packet is available on
request by calling 1-800-567-2685.  For questions regarding this policy,
call the 800 number and ask for Kerri McDonald."

Comments: I received a letter from this company a few days ago and called
them to determine if this would work for our Affiliates.  They were very
helpful and the agent is a dog person.  This will be another option for
our affiliates if they need one.

I move to add the following to the ASCA Policy book as Policy Number 2.3

The ASCA President will appoint an Affiliate Bylaws Review Committee whose
purpose shall be to review all new Affiliate Club applicants' Bylaws prior
to their being voted upon by the ASCA Board.  This Committee will also
review any changes to Bylaws requested by Affiliate Clubs.  If necessary
the Committee may consult with the ASCA attorney to settle any legal
issues regarding Affiliate Bylaws.

The Committee shall send their recommendation to the Executive Secretary,
who will include other required information before forwarding on to the
Board for approval.

Comments:  We have this Committee now and it has specific duties but it
has never been written down.  It needs to be on record.

92:20 Bylaw Revision--Four Committee Amendments

I move to accept the recommendations from the Bylaws Committee cited below
and that these proposed amendments and explanations appear in the May-June
issue of the Aussie Times---deadline March 15---as a separate stand-alone
section.  In addition, these proposed amendments and the explanation will
appear on the ASCA Web Page as a special link to remain in place until
acceptance or rejection of these changes by the membership.

Dear Directors,

The Bylaws Committee has been working industriously.  We have four
separate proposed amendments to the Bylaws ready for consideration by the
Membership (including the Board).  Initially a majority (6-2) of the
Committee desired that these proposed amendments be published in the
Aussie Times and be voted on by the Membership during the upcoming
elections for Director.  The Committee majority desired these important
amendments to be before the Membership as soon as possible.  Article XXI
in our current Bylaws is not in accordance with the Articles of
Incorporation and should have been corrected even before this.  Giving the
Membership the opportunity to change the years in ASCA from 8 to 5
consecutive years for eligibility for Director in the Bylaws Article, if
approved by the Membership, would enlarge the number of people who would
be able to place their names in nomination for Director.  The Membership
has made it clear they want a mechanism for putting matters before the
Membership for a vote.  The Committee's proposed amendments to Article V
and Article VI provide this mechanism for the Membership (as well as for
the Affiliate Presidents, and for the Board).  The Committee now has ready
an additional proposed amendment (revisions of Article XX) to be
considered by the Membership (including the Board).

However, after reflecting upon the matter further, the Committee decided
that it would be best to simply have these four items published in the
Aussie Times for comment from the Membership (including the Board) before
being considered by the Membership for a vote.  Thus the Committee is
simply requesting the Board to grant space in the Aussie Times for the
publication of the aforementioned items.  Be assured we welcome the
Board's comments on these items and the Committee stands ready to assist
in answering any questions you may have.

In addition to these four separate proposed amendments, immediately below
is an explanation entitled "Background Information Regarding Amendments to
Articles V and VI".  The matters in Articles V and VI are complex.  The
Committee has worked diligently to express the ideas in a clear and
logical manner so that all careful readers will be able to understand
easily how the process works.  This "Background Information " has been
prepared to accompany the proposed amendments to Articles V and VI when
they are submitted for publication in the Aussie Times.  Although this
information was prepared for the general membership, we believe that a
careful reading of this information by the Board will also assist the
Board in understanding the reasons for writing these proposed amendments
in the form now before you.

Although very careful work has gone into the preparation of these four
separate amended Articles, further improvements in the clarity of
language, or other possible improvements may have escaped the Committee's
eye.  We all know that careful review of Bylaws is highly tedious work.
Nevertheless, the Bylaws Committee will appreciate and will consider
carefully your suggestions that would further refine these amended
Articles.

Immediately below is the explanation of the proposed amendments to
Articles V and VI.

ATTENTION, MEMBERS---PROPOSED BYLAWS AMENDMENTS...

Introduction and Request for Comments

The Bylaws Committee has been working industriously.  We have four
separate proposed amendments to the Bylaws ready for consideration by the
Membership (including the Board).

The Bylaws Committee understands clearly that the Membership wishes to
have in place in the Bylaws a mechanism by which Members can get matters
of importance before the entire Membership for a vote.  The proposed
amendments to Article V and VI provide this mechanism.  These two Articles
have concepts that are intertwined, so you will need to consider the two
Articles together as a whole.  The matters in Articles V and VI are
complex.  This complexity is caused by the requirements of Washington
State law.  The Committee has worked diligently to express the ideas in a
clear and logical manner so that all careful readers will be able to
easily understand how the process works.  To assist you in understanding
Articles V and VI, the Committee has prepared helpful background
information that will tell you why these two proposed amendments have been
written as they have.  Please read with care "Background Information
Regarding Proposed Amendments to Articles V and VI" below before reading
the proposed amendments to Articles V and VI.

The language of the proposed amendments V and VI immediately follows this
"Background Information..." about thsee proposed amendments.  Next
following for your consideration are proposed amendments to three other
Bylaws Articles (Article VII, Section 4, Article XXI, and Article XX).

Please send your comments regarding each of these proposed amendments to
the Bylaws Committee.  If you like the way they are written, please let us
know.  If you have suggestions for improvement of the language of these
proposed amendments, tell us how they could be improved further.  If,
after careful reading, you find incomprehensible material, tell us what
part of the proposed amendment you find impossible to understand.  If
there are matters that you wish changed in the amendments (and if what you
wish changed is not contrary to Washington State law), please tell us that
too.

Finally, the Committee would like to know your preference regarding
organization of material for a Membership vote on these amendments when it
comes time to do that.  A substantial majority of the Committee believes
that the Membership would prefer voting on changes to the Bylaws in terms
of **separate** votes on logical sections (like you see in the amendments
to different Articles below).  However, these are the **Membership's**
Bylaws and it is the  Membership that needs to tell us how you would like
to vote on them.  When it comes time to vote, would you like to be able to
vote to approve or disapprove proposed amendments to individual (logically
separate) sections of the Bylaws (like what you see below)?  Or would you
like to have just a single vote on a whole new set of Bylaws replacing the
old Bylaws?

The Bylaws Committee will appreciate your careful examination of all of
the proposed amendments below.  Also, the Committee will deeply appreciate
comments you send to us.  The Committee will continue hard at work on
reviewing the Bylaws and will have additional proposed amendments for you
to consider in the next issue of the Aussie Times.

98:11 Obedience Rules--Reference Sheet

		Reference Sheet

Ring Size: Indoor rings should be 40 x 50.  In NO CASE shall the Utility
ring be less than 35 x 50.  For Novice and Open, the ring shall not be
less than 30 x 40.  Outdoor rings are to be 40 x 50.

Utility:

Distance between Bar Jump and High Jump should be between 18 and 20 feet.

Handler is to be about 20 feet away from the article pile.

Handler is to continue another 12 feet from dog after commanding the dog
to stand/stay.

Ideally, dog should go approximately 20 feet beyond the jumps for the
directed jumping exercise.

Gloves are to be positioned 3 feet inside of the ring barriers along one
of the short sides of the ring.

Open:

"Posts" are to stand 8 feet apart, facing each other for the figure 8
exercise.  (Also true in Novice)

For both the Retrieve over the High Jump and the Broad Jump exercises, the
team will set-up at least 8 feet from the jumps.

The dumbbell must be thrown at least 8 feet beyond the jump during the
Retrieve over the High Jump exercise.

The dumbbell must be thrown at least 20 feet from the handler during the
Retrieve on the Flat exercise.

No grooming or crating within 15 feet of any obedience ring during the
obedience portion of the show.  Clubs should insure that obedience rings
are used only for obedience trial, not for practice.  Ring should be
closed to everyone in between trials, unless the same ring is used for
both obedience and conformation.

Groups: A minimum of 2 dogs must participate in the Open group exercises
in order to obtain a qualifying score.  A minimum of 2 dogs must
participate in the Novice group exercises in order to obtain a qualifying
score.  A maximum of 12 dogs are allowed in the ring at one time for the
group exercises.

Dogs entered in non-regular classes cannot be entered in a regular class.

Broad jumps: Number of boards Distance jumped

	1. 16" to 24"
	2. 28" to 44"
	3. 48" to 72"

If using less than 4 boards for the Broad jump, always remove the tallest
board(s) first.

High jump and Bar jump will be set to the nearest 2 inch multiple for the
dog in question, unless the dog measures less than an even number.  In
that case, the jumps will be set to the next lowest height.

All breeds, except the ones listed below, will jump their height at the
withers.

The Obedience Committee recommends to the BOD the following changes to the
Obedience Rules, effective June 2001:

Chapter 8, Non-regular classes, Section 6 Versatility Class

Replace the second sentence with:
The following exercises will be performed, and there will be no group
exercises.  The exercises will be performed and judged as in the Regular
classes.

00:20 Registry Rules--Hardship Motion #1

Motion by Berryessa, second by Warren

I move that ASCA form a Hardship/LEP Evaluation Committee, as outlined
below.  Resumes for this committee must be received by July 1, 2001.
Until the Committee is formed, the ASCA office will continue the task of
viewing all applications for Hardship or LEP registry.

HARDSHIP & LEP COMMITTEE

The purpose of this committee will be to view all applications for
Hardship Registration and LEP Registration and to determine eligibility.

Requirements:

Three Committee members shall be appointed by the ASCA Board of Directors
for a two year term (the first appointed committee will have terms that
expire at the 2003 ASCA Nationals).  Committee members may reapply for
membership.  Members must have at least ten years of ASCA membership and
involvement in breeding and competing in ASCA programs.  At least one
committee member will have trained and/or competed with Australian
Shepherds in stockdog trials.  At least one committee member will be an
ASCA Breeder Conformation judge.

Procedure:

The ASCA Business Office will receive all applications and view them to
ensure they are properly completed and contain all necessary information.
Applications and required photos will be e-mailed or mailed to each of the
three committee members.  Members will have five days, exclusive of
weekends or holidays, to respond to the business office with an approval
or disapproval.  Disapproval will be accompanied by a brief explanation.
If there is a disagreement among the three members as to approval, the
comments of the disapproving member(s) will be forwarded to the approving
member(s) with an additional five days, exclusive of weekends or holidays,
to respond.  A majority decision will stand.

Any member who feels additional photos are necessary will notify the
business office and said photos will be requested while the application is
put on hold.  If the Committee feels it is necessary, they can require the
dog be viewed in person.

Directions to committee members:

All applications and decisions are strictly confidential.  Only dogs who
appear to be purebred Australian Shepherds will be accepted into the
Hardship Registry or the LEP Registry under the following guidelines.

Dogs are to be judged as to whether or not they exhibit traits typical of
the breed. Faults of structure do not disqualify a dog from being
considered for the Hardship or LEP program.  The ASCA Breed Standard
should be the guide.  Dogs with disqualifying faults per the ASCA breed
standard (other than recognized colors, white body splashes, undershot
bites; overshot bites exceeding 1/8 inch, monorchidism and cryptorchidism,
Dudley nose) will not be accepted into the Hardship Registry.

MOST IMPORTANT ARE THE QUESTIONS, "DOES THIS LOOK LIKE A PUREBRED
AUSTRALIAN SHEPHERD?"  and "DOES THIS DOG EXHIBIT CHARACTERISTICS MORE
TYPICAL OF ANOTHER BREED?"  Hardship registered dogs have the same
registry privileges as any ASCA registered dog including being used for
breeding. LEP registered dogs may compete in all ASCA programs except
conformation and thus represent the ASCA Australian Shepherd in the public
eye.

Comments: Lola has told us that she would feel more comfortable with these
resumes being reviewed by someone more familiar with the breed standard
and its accompanying disqualifications.

00:20 Registry Rules---Hardship Motion #2

Motion by Berryessa, second by Warren

I move that the following changes be made to our Hardship Application:

Delete the words: "if any" on the second line of the application

Delete the words: "Required only if Dam is ASCA Registered" and "Required
only if Sire is ASCA Registered" on the lines for the Breeder's signature
and the Sire Owner's signature.

Add after the 3rd sentence of the statement to be signed by the applicant
dog's owner "If it is discovered, after registration, that any part of
this application has been falsified, registration will be revoked for this
dog and any progeny."

Add after the above paragraph:  "I testify that the applicant dog does not
have any disqualifying faults as named in the ASCA Breed Standard (other

Change the 2 Revision dates on the back of the form to the appropriate
date.

Eligibility rules 4 & 5: Delete "If dam of applicant dog is already ASCA
registered" and "if Sire of applicant dog is already ASCA registered".

Eligibility rule 7: Replace with: "The applicant dog must hve been
registered with ASCA, IESR (NSDR), UKC, CKC (Canadian Kennel Club), or AKC
(any exceptions must be approved by the ASCA BOD).  The applicant dog's
parents and grandparents must have been registered with ASCA, IESR (NSDR),
UKC, CKC (Canadian Kennel Club), AKC or any combination of those
registries.  Dogs shall not be registered, now or in the future, as any
other breed (doing so will void the applicant dog and any subsequent
progeny's registration).  Dogs will not be considered under the Hardship
rules if both parents are ASCA registered."

Add Eligibility rule 8: Owners with dogs registered by registries not
listed above, will have to apply to the ASCA Board of Directors for
approval of the registry.

Add Eligibility rule 9:  Applicant dogs shall not have any disqualifying
faults as listed in the ASCA breed standard (other than recognized colors,
white body splashes, undershot bites, overshot bites exceeding 1/8 inch,
monorchidism and cryptorchidism, Dudley nose)".

Add eligibility rule 10: Applicant dogs already registered as "for
non-breeding" by another registry will only be registered as "for
non-breeding" by ASCA.

Add elgibility rule 11: All applicant dogs must have been DNA profiled by
an approved ASCA laboratory.

Registration requirements #2: Delete and change to:  "Submit a photocopy
of the applicant dog's registration certificate and DNA profiling
certificate."

Registration Requirement #6:  Add AKC to the list of registries.

Comment: The above motion tightens up the requirements for Hardship
registered dogs and clarifies some points:

bites exceeding 1/8 inch, monorchidism and cryptorchidism, Dudley nose).

2.  Add on at the end of the paragraph: ", but will be allowed in dogs
applying for LEP registration"

Comment: Concern has been raised that the rules might not be clear on
allowing LEP dogs to be registered that have Breed Standard
disqualifications.

I move that an announcement be placed in the Aussie Times May-June 2001
issue asking for resumes for the Hardship/LEP Committee.

The announcement will list the requirements for membership (Requirements:
Three Committee mmeber shall be appointed by the ASCA Board of Directors
for a two year term (the first appointed committee will have terms that
expire at the 2003 ASCA Nationals).  Committee members may reapply for
membership.  Members must have at least ten years of ASCA membership and
involvement in breeding and competing in ASCA programs.  At least one
committee member will have trained and/or competed with Australian
Shepherds in stockdog trials.  At least one committee member will be an
ASCA Breeder Conformation judge.)  The announcement will contain the
statement that the complete text of the committee rules is available from
the ASCA office.
