    Section 3.5 Currently it reads:

    Section 3.5 Non-Regular Classes and For Exhibition Only  (FEO) Classes
    3.5.1  Non-Regular
    Host clubs may offer any non-regular classes they  choose.  The club may set guidelines for those classes as to  entry requirements and goals for those classes, as long as those goals do not  conflict with the general philosophies of ASCA.

    3.5.2 Pre-Novice
    Host clubs may offer Pre-Novice classes for dogs over the  age of 12 months. Dogs entered in the pre-novice class must jump at least 4" lower than what their regular jump height is and the teeter-totter and weave  poles may not be used.  Other obstacles may be omitted at the  discretion of the host club.  Pre-novice courses are not required to be  judged by the judge of record and course review is not  required.  

    3.5.3 For Exhibition Only  
    Host clubs may accept "For Exhibition Only" (FEO)  entries, if they choose.  Dogs entered "For Exhibition Only" may  jump at a lower height than their regular jump height and must be clearly  marked as 'FEO' in the catalog. FEO runs shall be included along with  the Regular, Jumpers and Gamblers runs to calculate the Event Membership  Dues.  See section 2.6.5.3 and section  2.6.7.

    FEO entries may be accepted for dogs owned by the judge  or any member of the judge's household.  It is at the discretion of the  host club as to whether or not FEO entries can be  accepted. FEO entries may not compete for any prizes or awards (including any series, 'year-end', High in Trial, or merit  awards).  
     
    My motion would be to insert an age limit for FEO so the first paragraph in section 3.5.3 would read:

    Host clubs may accept "For Exhibition Only" (FEO)  entries, if they choose.  The minimum age for dogs entered "For Exhibition  Only" is 15 months of age.  Any dog younger than 18 months of age must jump at a lower height than their regular jump  height.  'FEO' entries shall be clearly marked as 'FEO' in the catalog  and included along with the Regular, Jumpers and Gamblers runs to calculate the Event Membership Dues.  See section 2.6.5.3 and section  2.6.7.

  • 5:02 National Specialty Rules: Final Ribbons

    I move that the following  be sent to each committee which manages a Finals for its input/comment about implementing the following changes to the for ASCA Final ribbon requirements.

    “The requirement for the Dog’s Name and Titles to be imprinted on the award ribbon as required in the National Specialty Hosting Rules and Final Rules for each venue shall be understood and interpreted to mean the Dog’s name as originally registered with ASCA and only the titles earned which appear before the Dog’s name.”  

    Rationale: By making all the ribbons uniform we would eliminate perceived differences between venues. By eliminating titles appearing after the name, the dog’s identification would be in larger type and more visible to all observers. It would also reduce the cost and reduce or eliminate errors in the ribbons, since they could be ordered and double checked against the Business Office records and not just copied from entry forms some of which are hand written.

    I move to make a one time exception to the six (6) ASCA sanctioned
    classes per trial per day rule (2.1.6 Trial Premium) to allow the 2010
    Host Club to conduct a seven (7) run agility trial.

    Comment/Rationale: Because of multiple administrative errors, a rule
    open to interpretation and at this point in the entry process this is
    an appropriate remedy. The Agility Committee is working on a
    clarification of the classes offered rules for the National Specialty
    Agility Trial.

    I move the following sections in the National Specialty Rules be changed:
     
    In Section 7 and in Section 7 Part 2:   
     
    Change all of the word " fields"  to the term "sites" to match our Tracking Regulations, and add a line describing a TDU site as follows: 
     
    In Section 7:  Rings and Tracking sites.
     
    Section 7.2. 
     
    TD sites must be open fields of consistent cover free of obstacles with at least 5-7 acres in each area for a TD track; TDU sites should be in urban or suburban areas with at least 4 acres for each TDU track. TDX sites must be of both open and mixed cover in an area with at least 20-27 acres for each TDX track.  Judges must approve the sites of the Tracking Test and determine the number of tracks before the Premium goes to publication.  Sites for the National Tracking Test cannot be changed once the Premium has gone to publication unless permission is given by both National Tracking Judges.

    I move to change section 1.7 of the Registry Rules which reads:

    Section 1.7 Foreign Registry Registration
    Purebred Australian Shepherds registered with other registries may be
    eligible for ASCA registration provided that all of the following
    requirements are met:
    1. The dog was registered as an Australian Shepherd in the country of
    birth with a foreign registry recognized by ASCA that has met one of
    the following requirements:
         a. Any registry with which ASCA has a reciprocal agreement (i.e.
    The Canadian Kennel Club)
         b. Any foreign club registry approved by the ASCA Board of
    Directors after review of the registry’s registration process
    (currently the American Kennel Club, The Kennel Club)
    2. Owners of applicant dogs registered with non-ASCA approved
    registries must seek approval for that registry by providing the ASCA
    Board of Directors with clear evidence of the foreign registry’s
    ability to accurately verify purebred Australian Shepherd lineage.
    3. If both parents of an applicant dog are ASCA registered, the dog
    must be registered through an ASCA Litter registration application.
    This dog is NOT eligible for Foreign Registration. (Eff. 10-01-09).
    4. Puppies from any litter born prior to the ASCA Foreign registration
    of the sire and/or dam will be treated as individuals; each puppy must
    meet the Foreign Registry Requirements.
    5. Registration of any applicant dog, its parents or its grandparents
    with any registry as a breed other than an Australian Shepherd will
    result in the applicant dog being ineligible for registration in the
    ASCA Registry.
    6. The application form is accompanied by a minimum three generation
    pedigree certified by the foreign registry and must include all
    registration numbers from that registry.
    7. The applicant must provide evidence that the applicant dog’s
    lineage is based 100% on ASCA registered dogs. Applicants must supply
    ASCA descendant registration numbers at time of application.
    8. The application form is accompanied by a photocopy of the
    registration papers certified by the foreign registry. The dog must
    have an unrestricted (for breeding) registration with that registry if
    applying for registration as “for breeding” in the ASCA Registry. This
    does not apply to applicant dogs applying to the ASCA registry as an
    Altered dog.
    9. The ASCA application and the foreign registry registration must
    show identical ownership.
    10. The dog must have permanent, readable microchip or tattoo identification.
    11. The dog must be DNA profiled with an official ASCA DNA laboratory.
    12. The owner must certify that the applicant dog does not have any
    disqualifying faults as described in the ASCA breed standard.
    13. The signature of all owners must appear on the application.
    14. The Breeder’s signature must appear on the application
    15. Three photos are required of the individual dog and must accompany
    the application form. Photos must be clear, color and show the dog’s
    front, left and right side full body view.
    16. If at any time it is found that any part of the application has
    been falsified or found to be untrue, registration will be revoked for
    this dog and any progeny. Disciplinary action may be taken against the
    owner. If you are interested in participating with your purebred
    Australian Shepherd in ASCA’S® many performance programs including
    Agility, Stockdog, Obedience and Tracking you may want to consider
    enrolling your dog in ASCA’s® Limited Exhibition Privilege (LEP)

    Comment/rationale: This change clarifies the requirements for
    submitting pedigrees and the grounds for refusing registration. The
    change also contains editorial changes to clarify the language.

    I move the following changes be made:
     
    Add to the ASCA Policy book under Sec 23.3 ASCA Power of Attorney: The ASCA Power of Attorney form must be on file with the ASCA Business Office in order for anyone to sign an official form for any ASCA business.
     
    Place the following under Sec 1.1 in the Registry and General Rules applicable to all programs:
     
    Power of Attorney: In instances where a Power of Attorney is needed for signing of registry forms, an ASCA Power of Attorney form must be completed and be on file with the ASCA Business Office.
     
    Place the attached ASCA Power of Attorney form in Chapter 3 of the Registry and General Rules applicable to all programs.
     

    Comments: This should make it easier for the office to handle POA requests.

     I move that the following (also attached) “Certified Breeder’s Code of Ethics be adopted by the Australian Shepherd Club of America.

     Rationale: Since there are jurisdiction which have or are considering adopting restrictive dog laws, and even though we opposed them they may become law. Further most of these new regulations have clauses which allow breeders, who are governed by enforceable standards of their breed club, to be exempt from such new law requirements (such as Los Angeles County). We should give our member breeders who wish to take advantage of such exemptions the means to do so. Further the vast majority, if not all of the adverse comments had to do with not “giving in to the “animal rightists’ and not any substantive provision of the CBCE. Further the CBCE create nothing new from the existing Guidelines other than enforceability and the restriction of which Breeders and Stud dog owners can be listed on ASCA’s web site.

    AUSTRALIAN SHEPHERD CLUB OF AMERICA CERTIFIED BREEDER CODE OF ETHICS

    The Australian Shepherd Club of America (ASCA®) in furtherance of its Mission Statement (promoting the responsible breeding and registering of purebred ASCA Australian Shepherds and to do all in its power to bring their natural qualities to perfection), has adopted the following Certified Breeder’s Code of Ethics to promote and foster the highest standards among breeders, stud dog owners, and fanciers, and to encourage the improvement and advancement of our breed. Breeders and owners of Stud Dogs who voluntarily agree to subscribe and uphold the standards of conduct and behavior stated in this Breeder Code of Ethics shall have the right to be known as and call themselves ASCA Certified Breeders or ASCA Certified Stud Dog Owners  (hereafter collectively referred to as “Cert.Br.”). Only ASCA Certified Breeders and ASCA Certified Stud Dog Owners, who request to be listed shall be displayed and/or shown on ASCA’s web site.  
    ARTICLE I RECORDS

    1. Each Cert.Br. who breeds his/her bitch or uses his/her stud for services shall keep accurate records of said breeding stock for a minimum of five (5) years.  The records shall include, but are not limited to, stud services, pedigrees, all litters produced, sale of dogs/puppies, all contracts and documents (paperwork, including emails, relating to the sale or transfer of ownership) involving Australian Shepherds.
    2. Any Cert.Br. failing to keep such records, falsifying a registration or knowingly misrepresenting a pedigree shall be subject to disciplinary action.  
    ARTICLE II BREEDING
    1. The Cert.Br. shall plan each breeding with the primary goal of improving the breed.
    2. The Cert.Br. shall endeavor to select sire and dam to optimize structure, temperament, and working ability following a careful study of the ASCA Breed Standard, pedigrees, and basic principles of genetics.
    3. A Cert.Br. shall only breed mature dogs and bitches that are no less than two (2) years of age.
    4. Before entering into any breeding agreement the Cert.Br. shall review pedigree, structure and working potentials of both sire and dam keeping in mind the Cert.Br.’s goal established in paragraph 2 above.  The Cert.Br. shall refuse the breeding if, in his/her opinion, it is not in the best interest of the breed.  
    5. A Cert.Br. shall only breed bitches and studs whose owners meet the requirements of this Breeder Code of Ethics and bitches and studs meeting the requirements of paragraph 6 below. It is not necessary that the owners are Cert.Br., provided the owners are deemed to meet the above requirements.  
    6. A Cert.Br. shall not knowingly shall use for breeding purposes any dogs/bitches, which are not free from, defects such as monorchidism, cryptorchidism, deafness, albinism and other disqualifying defects.
      1. Cert.Br. shall use only those dogs/bitches whose hips have been x-rayed for Hip Dysplasia and rated fair to excellent by a qualified radiologist or Penn Hip ratings or other rating systems with values which are deemed equivalent.
      2. Cert.Br. shall take care to use only dogs whose eyes have been examined and found free from signs of ocular deformities considered genetic.
      3. Cert.Br. shall further refrain from using a dog that, although free from the above defects, has consistently produced afflicted puppies.

    ARTICLE III HEALTH
    A Cert.Br. shall maintain high standards of health and care for his dogs and guarantee that the puppies are healthy at the time of sale.
    ARTICLE IV SALES
    1. The Cert.Br.  shall be discriminating when selling his/her puppies, with the utmost concern to the appropriate type of homes in which they are placed.  Australian Shepherds shall not be donated for raffles, give-aways, or sold to dog wholesalers or retailers, such as pet shops. If the time comes that a carefully placed dog needs to be rehomed due to unforeseen circumstances, the Cert.Br., whether the owner of the bitch or the stud dog, is responsible for temporarily re-homing of such dog until the dog can be rehomed.
    2. The Cert.Br. shall either clearly state in a written contract that either there are no guarantees or give a guarantee providing at a minimum  (i) a six (6) month guarantee against crippling or handicapping congenital defects on all puppies sold; (ii) guarantee the sale of breeding stock puppies against hereditary defects and disqualifying faults for a like period and (iii) clearly state what other guarantees, if any, are given. All guarantees shall, as a minimum, provide for replacement of the puppy with another or refund of the purchase price, within a reasonable length of time after return of the puppy originally purchased, if still living. Should the buyer wish another puppy from the dam but a litter is not planned for some future time, the buyer can receive a refund and, if agreed to by both parties, secure a place on a waiting list for the future litter.
    3. The Cert.Br. shall transfer all applicable registration papers to the buyer when the purchase agreement is entered into by both parties but not later than the date the puppy or dog/bitch is delivered to the buyer. Such registration papers shall display whether the dog is allowed to be bred, “Not for Breeding”(offspring can’t be registered), and also if the dog is required to be neutered. If the dog is required to be neutered, it shall so be designated on the registration papers by checking the box, “Veterinarian Certificate of Neutering Required” then a certificate from a licensed veterinarian must accompany the registration papers when sent to the Business Office in order for the dog to be registered in the buyer’s name.
    4. Upon sale of a dog/puppy, the Cert.Br. shall provide all buyers with (i) a two (2) or more generation pedigree with, if available, color of coat, and eye color (ii) diet and care information, (iii) health guarantee, if any, and (iv) inoculation record (including date and type of serum.)
    5. The Cert.Br. shall not deliver a puppy until it is at least eight (8) weeks old.  If the puppy is to be shipped to the buyer, the puppy should be held until the puppy is older than eight (8) weeks.
    6. Unless required to do so by law, a Cer.Br. shall not knowingly allow one of his/her breeding, puppy or adult dog, to be disposed of in an animal shelter or pound or allowed to remain in the care of a rescue organization.
    ARTICLE V ADVERTISING
    1. The Cert.Br. agrees and shall assure that all advertising of dogs/puppies is factually correct and honest both in substance and implication.
    2. The Cert.Br. shall be cautious when encouraging buyers as to breeding potential of the purchased dog.  The breeding of Australian Shepherds is not to be taken lightly.

    ARTICLE VI MEMBER RELATIONS
    1. The Cert.Br. pledges to help educate the general public as well as graciously assist the novice breeder in all areas with which he/she is familiar.
    ARTICLE VII IMPLEMENTATION
    1. Any infractions of this Code shall be reported in writing to the ASCA Board of Directors, the Executive Secretary or the Business Office.
    2. When a Cert.Br. fails to adhere to this code and is not cooperative in rectifying a breach of this Code or other error, disciplinary action will be taken.
    3. The Board of Directors of ASCA shall have the sole authority to discipline the Cert.Br.  who violates this Code of Ethics.
    4. The Board of Directors of ASCA, in its sole discretion, may impose sanctions or other disciplinary actions for violations of this Code of Ethics. Such sanctions and/or disciplinary actions may include but are not limited to the following:
    ·      Removal of recognition as a Cert.Br. and removal from the ASCA web site.
    ·      Fines
    ·      Required educational instruction
    ·      Community service
    ·      Suspension of registration privileges
    ·      Suspension of membership
